The rental of any ski or winter sports equipment via our site (www.skidiscount.fr) implies an understanding and acceptance of the following terms and conditions:-

These terms and conditions are subject to change, the conditions that apply are those that appear on our site at the time of reservation.

TERMS AND CONDITIONS FOR HIRING WINTER SPORTS EQUIPMENT ON THE SKI DISOUNT WEBSITE rented exclusively to clients skiing in France.  For this purpose we ask you to take care to register your correct address.

The equipment proposed for rental are described on the present site, specifically that the client has reserved a level of equipment and not a particular model.

 

Article 1 – DATE OF EFFECT – AVAILABILITY AND COLLECTION

1. The hiring takes effect at the time when the customer takes possession of the material in the SKIDISCOUNT store, for the duration indicated on the signed leasing agreement. It ceases per the date and hour indicated by the leasing agreement.
The material can be collected on the first day of skiing when the shop opens or the day before  starting from 15:30 and must be returned by the end of the last day of hiring or the following day before 10am.  Any equipment returned after 10am the day after the specified rental end-date will involve the SKIDISCOUNT store concerned charging for one extra day of hire based on the prices posted in the shop.
All responsibility for all equipment will be transferred at the hand-over from the shop to the customer who will assume full charge of it.  The leasing agreement is in force only for the duration of the hire dates stated. If the customer keeps the material beyond the return date without having  advised the shop of any changes in advance, he/she loses the benefit of all the guarantees included within the leasing agreement.

2. The responsibility for the collection of the rented products lies with the person carrying out the hiring, the rental contract stays with the store where it was signed.
 In the event of delay for the collection of the rented products, the customer will need to inform the resort store as soon as possible. The products will thus be kept back for the customer for a period of 24 hours. At the end of this period, they will be released for hire, without any allowance due to the customer. The product will have to be returned to the shop where it was hired

Article 2 - PRICE OF HIRING AND MEANS OF PAYMENT

1. PRICE OF HIRING
The price of hiring is determined by the range of material chosen by the customer, the selected period and the date of reservation.
General terms: Flat rate SKIDISCOUNT applies for any reservation carried out up to 30 days minimum in advance of the collection of material.
100% of the hire amount will is taken at the time of reservation.
The prices indicated are subject to change without notice, knowing that the items will be invoiced based on the going rate according to the date and time of the order.
The tariff tables for SKIDISCOUNT.COM can be different from the prices advertised in store.
The RENTAL offer can not be used in conjunction with any other promotional offers such as (group discounts, company group discounts, discount vouchers etc…)

2. SAFE PAYMENT THROUGH THE SITE
SKIDISCOUNT have installed the payment service from the Banque Populaire concerning their e-business, this payment service is called “Cyberplus Payment”. This payment service aims to ensure all functions necessary for the management of a payment service and to protect the acquisition of payments made on the internet.  Banque Populaire manages the security of the exchange and makes sure to protect all privacy (cypher keys) and their management.
The customer must pay directly for his hire online by bank card (Visa, Eurocard or Mastercard). He must then enter the 16 digit long number, the expiry date and the 3 digit cryptogram from his bank card. 
Only bank cards with the initials CB, VISA, EUROCARD or MASTERCARD created in FRANCE or within the global network area approved by the GIE Bank cards, are accepted.
The order validated by the customer on the Internet site will be effective only when the central network of bank cards gives its agreement. In the event of the refusal of a card, SKIDISCOUNT reserves the right to cancel the reservation. If possible, the customer will be contacted by e-mail or telephone as soon as possible.
At the time of the payment transaction, the customer is automatically connected to the waiting area at the center for processing payments.  The banking data, protected by encoding, does not become forwarded to the systems of SKIDISCOUNT and are therefore not kept by it.
The reservation is concluded and does not become effective until it is cashed by SKIDISCOUNT, according to what was said before, the entire amount for the hire and collection by the customer is sent in a confirmation email including/understanding the Goods Exchange, to print out and be presented by the customer to the selected SKIDISCOUNT store. 

Article 3 - USE
1. The customer certifies to being ready and able to make use of the rented material which he is committed to use him self. Any deliberate use of the parts, wrongful use of the loan or the sub-letting of the rented equipment is strictly prohibited.
2. The customer commits himself to using the property leased, without danger to third parties in accordance with the regulations in force. He commits himself to constantly maintain it in good condition and to use it and maintain it according to the regulations of use. No guarantee covers a possible defect from adaptation of the material rented to the specific needs of the customer or adjustments other than those carried out by official SKIDISCOUNT stores. 

Article 4 - AVAILABILITY OF the PRODUCTS OFFERED TO the HIRING
Store SKIDISCOUNT, can not be held responsible for any delays in availability due to reasons out of their control, in particular: in case of accidents, in case of delay in the return of materials from the previous clients, modifications of the regulations, Force Majeur, strikes…
However, in the case of unavailability, the SKIDISCOUNT store will propose, according to its stocks, a material of equal or higher quality for the same price.
Article 5 – DEPOSIT
The client agrees to return all the equipment in proper order and in the same state that it was rented and handed over.  Any problems or marks affecting the state of the material must be marked on the contract when it is signed.  It could affect the deposit for the amount equal to the public price including taxes, for the sale of the product.  The deposit will be left in the form of a cheque, the imprint of a credit card or a pre-authorisation of collection. The deposit cheque will be given back at the time when the equipment is all returned, except in the case of repairs indicated below. 
The shop SKIDISCOUNT reserves the right to demand 2 pieces of identification before they accept a deposit cheque.

Article 6 - REPAIRS
1. The customer commits himself to paying for any repairs or replacement expenses for the material rented whatever the cause of repairs, except those due to fair wear and tear. Repairs will be carried out exclusively by the SKIDISCOUNT shop, to be charged to the customer.
2. All the materials, equipment and accessories whose repairs prove technically or economically  unfeasable will have to be paid for at the SKIDISCOUNT store by the customer at the price of replacement indicated in the store.

Article 7 - RESPONSIBILITY - INSURANCE
Subject to the execution of the obligations rising from the contract, the customer profits from the following provisions, except in cases of fraud:
1. Except if the customer already has travel insurance to cover “theft, breakage” as seen in paragraph 2 below, the customer does not profit from any cover for any damage done to the winter sports material rented and fully accepts personal responsibility for the aforesaid damage whatever is the cause. However, the customer could not be held responsible for the detrimental consequences of any latent defects of the rented material or unsuitable non apparent wear and tear from use for which it is intended, if the proof of the aforesaid defects or wear and tear can be brought to bear by the customer.
2. We inform you that the customer can choose to be covered against the risks of damage, loss or theft and this must be paid for at the time of signature of the rental contract for hand-over of the equipment, directly in the SKIDISCOUNT store concerned which offers this supplement freely defined as advertised in our store.
This option allows the customer to be exonerated, subject to an excess depending on the particular SKIDISCOUNT store pertaining to the level of refund to the store in the event of damage, loss or theft of the rented items.  In the case of the latter two, justification must be provided from an official declaration of loss or an original record of the police report from the Gendarmerie or the police services.
This acquired exemption always requires an excess whose amount is fixed freely by each store. The payment of this excess is to be settled at the end of the reservation dealt with directly by the store concerned. The payment of this excess is in addition to the payment of the equipment hire carried out.
- in the event of breakage: to return the material damaged with SKIDISCOUNT stores the item(s) will have to be recognizable and complete.
3. In case of theft by the customer, or damage from a sub-let of the equipment or unspecified damage to the material resulting from the non-observance of the rules of use or the regulations in force, or the terms and conditions of this contract, SKIDISCOUNT is entitled to exert a demand for the total sum of the damage.

Article 8 – RETURNING EQUIPMENT
The materials can only be returned to SKIDISCOUNT stores during their opening hours, bringing back equipment at the end of the last hire day or the following day before 10am.  For safety reasons, the customer is obliged to describe to the rental personnel any possible shocks received by the helmets.

 

Article 9 – PROPERTY OWNERSHIP
Neither the identification stickers of the rental shop fixed to the equipment, nor any inscriptions made by the rental shop on their equipment must be removed or modified by the customer.  The equipment can be neither sold nor used as guarantee.  The customer consents to relinquish all rights, real or other, pertaining to the materials hired, for the benefit of whoever, enough to affect the pleasure or to limit the availability or the ownership of the renter. 

Article 10 – CANCELLATION CONDITIONS
The customer has a time frame of 7 clear days, to retract, from the date of the contract signature.  If this time expires during a public holiday or non-working day, it would be extended to the first following business day.
However, this right of retraction can not be extended any more if the hiring started, with the agreement of the customer, before the expiry of the seven days period.
Cancellation before collection of the material and after the time of retraction:
During school holidays:
- Any cancellation of up to and including a 5 day hire will involve the refund of the hire minus a 3% cancellation fee. 
- Any cancellation of up to and including 4 or 3 day hire will involve the refund of the hire minus a 50% cancellation fee. 
- Anything less than a 3 day hire can not be canceled and no refund can be given.
Outside school holidays:
- Any cancellation for 3 or more days of hire included will involve the refund of the hire minus a 3% cancellation fee. 
- Any cancellation of hire for 2 days will involve the refund of the hire minus a 50% cancellation fee. 
- Anything less than 2 days can not be canceled and no refund can be given. 
The original sum is only refunded in the event of a cancellation falling within the right to cancel, due to a legitimate delay, or in the event of a death in the family of the customer involving the cancellation of their stay (must provide document for proof of death), with the deduction of the sum of 1€ including all taxes by anybody for the file expenses.
Any refunds are carried out by crediting the bank card used for the original transaction. 
For any other cases of cancellation intervening before the collection of equipment, the entirety of the sum is credited minus the file expenses. 
After receiving the material:
In the event of illness or of accident occurring during the hire period, the conditions of hire remain in effect.  Only the material rented by the person concerned can be restored and invoiced in proportion to the number of days of hire actually used (on presentation of a doctor's certificate).
In this case, a refund (minus the sum of 1 euro including all taxes for file expenses) will be carried out by crediting the bank card used for the original transaction. The start day of any hire period will not be refunded.
Climatic risks: In the event of a TOTAL close of the ski area normally accessible from the place where equipment has been hired, and only in this case, the days of non use of hire equipment will be taken off the final bill.

Article 11 - AVOIDANCE CLAUSE
At the end of a hire period, as stated within the contract, in the event of un-returned items or an unpaid partial invoice, the customer remains responsible for the material in his possession. Its return is obligatory at the end of the hire period as stated by article 314-1 of the New Penal code, without it being necessary to send an injunction by registered letter with acknowledgment of delivery and without the customer being able to call upon any prevention.

Article 12 - APPLICABLE LAW & JURISDICTIONS
This contract is subject to French law. In the event of an unspecified dispute relating to the present contract, the Court of Jurisdiction will be that nearest the head office of the company managing the SKIDISCOUNT stores, having carried out the delivery of the material to which the parts allot an exclusive competence.
Article 13: DATA-PROCESSING LAW/PERSONAL DATA PROTECTION
The personal data collected from internet sales is obligatory, this information is necessary for the order and delivery process as well as creating invoices.
The process of any Danisports order on the http://www.skidiscount.fr/  site, requires the creation of a Clients' account, in which personal Customer information is stored, and protected by a password, chosen by the Customer.
This information is strictly confidential and is not passed on to Danisports. The information is treated with the strictest of respect in accordance with the law n°78-17 created on January 6, 1978 relating to data processing, the files and freedoms. In the situation where Danisports, in part or whole is acquired by a third party, the Customer data for http://www.skidiscount.fr/.com will be included in the sale.
In accordance with law n°78-17 of January 6, 1978 relative to the control of client data, concerning files and freedoms, the personal data collected on the http://www.skidiscount.fr/ site must be declared to the National Data Processing Freedom Commission, recorded under the n°1393767 10/11/2009. At any time the Client has the right to access, modify, correct and delete the data relating to themselves. To exert this right, the Customer can directly contact us with their reference which is their email address and name, on the site http://www.skidiscount.fr/ or they can ask by sending an e-mail to Customer Services:

The use of information which the Customer provides to third parties on other sites or that these third party sites collect on other internet sites is not governed by the article “Protection of personal data”. http://www.skidiscount.fr/ cannot be held responsible for any third party.
Danisports offers Client, information, by email, likely to interest him via the “newsletter http://www.skidiscount.fr/”. If the Customer does not wish to receive this information by email, it must un tick the corresponding box. After accepting, the Customer can choose not to receive further communication by contacting the Customer services by email at: info@danisports.com
Cookies.
Skidiscount.fr makes use of cookies. The cookie is an electronic file stored on the hard drive of the Client’s computer. The purpose of it is to improve the speed of navigation for the user. The cookies are automatically removed at the end of the transaction. The Customer reserves the right to refuse cookies by configuring his Internet navigator. He then loses the possibility to personalise the service given by http://www.skidiscount.fr/ via its Internet site.
